FAZ dos not condone the trading or selling of any items belonging to Neopets Inc., GAIA Interactive Inc., Jagex Limited (the creators of RuneScape), Wajas, Inc., deviantART and any other company that we are not yet aware of that prohibits these actions in their Terms of Service. However, FAZ will NOT attempt to interpret or enforce other companies Terms of Service, but we will comply with any legal inquiry directed to our attention in an attempt identify anyone who has broken another companies Terms of Service.

Excerpts are posted below for your reference only. Please check the respective company's website for the most up to date version of the terms of service.

VII. NO RESALE OR REPRODUCTION OF SERVICE(S)
You agree not to reproduce, duplicate, copy, sell, trade, resell or exploit for any commercial purposes, any portion of GAIA Online including, but not limited to your GAIA Online User ID. You are not allowed to reproduce any portions of the GAIA Online website outside of the scope of the GAIA Online Experience without prior consent from the creators of GAIA Online.

VIII. TERMINATION
You agree that GAIA Online may, under certain circumstances and without prior notice, terminate your GAIA Online account and any associated information pertaining the User. Causes for such termination include but are not be limited to:

1. Breaches or violations of the TOS or other incorporated agreements or guidelines.
2. A request on the part of a parent or guardian, if the User is under 18 years of age.
3. A request on the part of a law enforcement or other government agency.
4. A request initiated by you, the User.
5. Unexpected technical or security issues.
6. Use of fraudulent funds to make donations.

Upon termination of the User's account, all Content contained therein: Avatar, Gold, items, and other features provided by the site and which are not explicitly covered in the TOS will be permanently deleted. GAIA Online reserves the right to deny Service to a former User.

1. Neopets Is A Game, Not A Way To Make Money.
As a guest you do not own the accounts, activities, items, Neopoints, characters, locations, faeries, games and pets on the site; they are for you to play with while on the site. Except as permitted by the functionality of this site, you can't sell them (for money or Neopoints), give them to anyone, trade them for anything (including Neopoints), or pretend you made them. This means that you cannot try to make money off the Neopoints or virtual items in your account or even sell the time it took you to collect such items and Neopoints. If we find someone selling Neopoints or items, we will freeze every account controlled by that user and every account of the user who purchased such Neopoints or items.

DENIAL OF ACCESS
Neopets, for any reason and at its sole discretion, may decide that any person shall be denied access to any part of the neopets.com site. The sending of an e-mail notice by Neopets to any e-mail address used by a person who is subject to the denial shall constitute complete and sufficient notice of the denial. By agreeing to these Terms and Conditions, you agree to cease and desist immediately from any attempt to access the site upon issuance of a denial. If you do not cease and desist, you hereby consent to an injunction to be entered against you by a court of competent jurisdiction, as provided herein, permanently enjoining you from attempting to access the neopets.com site.

Q. Can I sell my time it took me to earn Neopoints to someone on eBay, or on another auction site?
A. Nope. Now Lawyerbot could bore you to death with the legal explanation but think about it this way. Could you sell your time recording someone else's music? Could you secretly record a movie and charge the buyer the time it took you to record the movie? Could you type up someone else's book and then sell your typed version by charging for your time to type it up? Of course not. As you don't own Neopoints, you can't sell them or the time it took you to accumulate them. When we find someone selling Neopoints, we freeze the seller's accounts and all the accounts of anyone who has purchased the Neopoints. (By the way, often the seller won't reimburse your money when you are frozen after receiving the Neopoints and eBay and Verisign have a policy against requiring the reimbursement for the purchase of virtual items. Therefore, purchasing Neopoints can result in all your accounts being frozen and you losing your money).

Trading RuneScape items or services
RuneScape items may only be exchanged for other items/services within the game. You must not act as an intermediary to help others make infringing trades. You may not 'sell the time' you have invested in your account or items, since this falls under selling an in-game service. basically these are things you can and can't trade art for. like technically you shouldn't be able to sell art for neopoints and gaia gold.. i think.

Yeah, they encourage people to trade gold for art via this mentioned forum. Lemme see if I can dig anything up....



It doesn't clearly state that it's art-for-gold, but listed below are no fewer than at least a hundred different topics advertising drawing services for varying amounts of Gaia gold.

I suppose if you really wanted to stretch it you could say that the transactions needed to actually be discussed on Gaia online, but cutting out the middle man is a lot easier and so long as Gaia gets their monthly donation letter cash rake-in I really don't think they mind all too much  :D

Edit: I'm sending a PM to Gaia admins to double-check if this is actually okay.

Edit edit: I made a forum post in the 'Questions and Assistance' forum on Gaia online instead.

Please be careful to read my post. You'll notice that this is a cross-port with FAM. I do not enforce, nor interpret other websites rules. This post is merely an advisory that you are responsible for knowing the ToS for the sites that you are using. The post only came about because I was contacted by administrators and/or moderators of some of the above mentioned sites and therefore, for the interest of the community, this post was created to clarify my own position to you and to them.

The post here is less applicable than it is at FAM because almost all sales here involve the trading of items for artwork. However, on FAM, where the original post was made, the rules are more applicable because often times items are sold for cash.
